  4. THIS IS A LICENSE.  IT GIVES YOU CERTAIN LIMITED RIGHTS TO USE THE
  5. SOFTWARE AND SOFTWARE COPIES.  YOU DO NOT BECOME THE OWNER OF, AND
  6. EXECUTIVE SYSTEMS, INC. ("ESI") RETAINS TITLE TO, ALL OF THE SOFTWARE
  7. AND SOFTWARE COPIES.  ALL RIGHTS NOT SPECIFICALLY GRANTED IN THIS
  8. LICENSE AGREEMENT ARE EXPRESSLY RESERVED BY ESI.
  9.  
  10. DEFINITIONS:
  11.  
  12.      The term "Software" as used in this Agreement means the computer
  13. program, XTree 2.00E, contained in the disk(s) in this package.
  14.  
  15.      The term "Software Copies" means the actual copies of all or any
  16. portion of the Software, including backups, updates, merged, or
  17. partial copies permitted hereunder or subsequently supplied by ESI.
  18.  
  19.      The term "Retailer" refers to the supplier of the Software
  20. product to you, namely Public Brand Software.
  21.  
  22. REGISTRATION:
  23.  
  24.      You must register the product within thirty (30) days of first
  25. use in order to receive ongoing technical support, manuals, and notice
  26. of new products or upgrades.  To register, you may write or call:

  33. Otherwise, the limited rights granted by this license expire and you
  34. must remove the software from your permanent storage device (hard
  35. disk).

  37. PERMITTED USES:
  38.  
  39. You may:
  40.  
  41. * Load into RAM and use the Software on a single terminal or a single
  42. work station of a computer (or its replacement).
  43. * Install the Software onto a permanent storage device (hard disk
  44. drive).
  45. * Make and maintain one backup copy of the Software provided it is
  46. only used for backup purposes, and you keep possession of the
  47. backups.  In addition, all of the information appearing on the
  48. original disk label(s) (including any copyright notices) must be
  49. copied onto the backup disk labels.
  50.  
  51. USES NOT PERMITTED:
  52.  
  53. You may not:
  54. * Make copies of the Software, except as permitted above.
  55. * Use the Software in a network or multiple user arrangement.
  56. * Rent, lease, sub-license, time-share, lend, transfer, receive
  57. commercial benefit, or any consideration for the Software, Software
  58. Copies, or your rights under this license except that transfers may be
  59. made with ESI's prior written authorization.
  60. * Alter, decompile, disassemble, modify, create derivative works, or
  61. reverse engineer the Software or Software Copies, or make any attempt
  62. to unlock or bypass the initialization system used on initialized
  63. disks.
  64. * Remove, obscure, or change any copyright, trademark notices, or this
  65. License Agreement as they may appear in the Software, documentation,
  66. user interface, menus, and magnetic media.
  67.  
  68. ADDITIONAL RESTRICTIONS:
  69.  
  70.      In the event this Software is of any of the following types,
  71. these additional restrictions apply:
  72.  
  73. * United States Domestic Products - Software and Software Copies may
  74. not be used outside the United States without the prior written
  75. authorization of ESI.
  76. * International Products - The United States Department of Commerce
  77. imposes certain restrictions on exports of technical data including
  78. Software and Software Copies, to certain destinations.
  79. * United Kingdom Products - You may not use or resell the Software and
  80. Software Copies, outside E.E.C. member countries.
  81.  
  82. DURATION:
  83.  
  84.      This Agreement is subject to registration as specified above,
  85. effective from the day you open the sealed packet or for a period of
  86. thirty (30) days.
  87.  
  88.      If you breach this Agreement, ESI can terminate this license upon
  89. notifying you in writing.  You will be required to return all Software
  90. and Software Copies.  ESI can also enforce all other rights at law or
  91. in equity.

  93. GENERAL:
  94.  
  95.      XTree (R) is a registered trademark of Executive Systems, Inc. 
  96. All rights are reserved worldwide.  This ESI product is NOT "Public
  97. Domain" and it is NOT "Freeware".  ESI is a copyrighted software
  98. product developed and owned by Executive Systems, Inc., located in San
  99. Luis Obispo, California, U.S.A.  This Agreement represents our entire
  100. understanding and agreement regarding the Software and Software Copies
  101. and supersedes any prior purchase order, communications, advertising,
  102. or representations.  This licens may only be modified in a written
  103. amendment signed by an authorized ESI officer.  If any provision of
  104. this Agreement shall be found to be unlawful, void, or for any reason
  105. unenforceable, it shall be deemed severable from, and in no way shall
  106. affect the validity or enforceability of, the remaining provisions of
  107. this Agreement.  This Agreement shall be governed by the laws of
  108. California.
  109.  
  110. THIS PRODUCT IS LICENSED "AS IS" WITHOUT ANY WARRANTY OF
  111. MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, OR
  112. OTHERWISE; ALL WARRANTIES ARE EXPRESSLY DISCLAIMED.
  113.  
  114.      NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, ESI
  115. SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU FOR
  116. CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING BUT NOT
  117. LIMITED TO LOST PROFITS, EVEN IF ESI HAS BEEN APPRISED OF THE
  118. LIKELIHOOD OF SUCH DAMAGES OCCURRING.
  119.  
  120. You acknowledge that you have read every provision of this Agreement.
  121.  
  122. U.S. GOVERNMENT RESTRICTED RIGHTS
  123.  
  124. The Software and Software Copies are provided with RESTRICTED RIGHTS. 
  125. Use, duplication, or disclosure by the Government is subject to
  126. restrictions as set forth in subdivision (c) (1) (ii) of the Rights in
  127. Technical Data and Computer Software Clause at 48 C.R.R.
